The Supreme Court petition challenged the July 29 notification of the centre and the Medical Counselling Committee (MCC) to provide 27 per cent reservation to OBC and 10 per cent to EWS students in all India quota medical seats. The top court heard arguments made by Senior Advocates Arvind Datar, Shyam Divan and P Wilson.
The NEET PG counselling was scheduled to commence on October 25, but was deferred till further notice due to intervention of the apex court. The resident doctors are protesting for long against the delay in NEET PG counselling.

The Supreme Court agreed to take up the matter related to the Economically Weaker Section (EWS) quota in connection with the NEET-PG counselling following centre's request on an urgent hearing in the matter.
A bench comprising Chief Justice of India (CJI) N V Ramana and justices Surya Kant and Hima Kohli took note of the submissions of Solicitor General Tushar Mehta, who appeared in the court on behalf of the Centre, that the matter pertains to admissions to post-graduate medical courses and that students have been facing difficulties.

While the Medical Counselling Committee (MCC) is yet to announce the schedule for AIQ NEET UG counselling, several states have already started the counselling process for 85 per cent seats.
NEET UG, PG Counselling 2021: The MCC said candidates will not be allowed to apply for upgradation of seats or free exit after round 1. This means after round 1 seat allotment result, candidates can apply for upgradation of seats in round. However, after round 2, they can not apply for upgradation in the mop-up round and so on. Moreover, if candidates join the allotted seats in round 2, they can not resign the seats and participate in the further rounds. However, if they do not join the allotted seat in round 2, they can apply for the mop up round if they forfeit the security deposit and register fresh.

MCC NEET counselling 2021 will be conducted in four rounds this year — AIQ round 1, AIQ round 2, AIQ mop-up round and AIQ stray vacancy round.
While the MCC has introduced some changes to the AIC NEET counselling scheme, the process will remain same as previous years for central institutions. “The proposed modified scheme of Online 4 rounds of counselling will be in tune with the prevailing norms of counselling (including the fees and security deposit) being followed for Central Institutes/Universities,” the MCC said earlier.
States including Rajasthan, Tamil Nadu, Karnataka, Assam, Himachal Pradesh and Gujarat have started the NEET counselling process.

While announcing the NEET UG, PG judgement on reservation, Justice DY Chandrachud said: "We have upheld the constitutional validity of 27 percent reservation for OBC in NEET PG AND UG. For EWS this year, the 10 percent will apply for this year and the prospective ruling will be decided on a final EWS hearing to be held on March 3, 2022." (Bar & Bench)
The Supreme Court has upheld the decision on the EWS, OBC reservation case, meaning the court has approved the OBC reservation quota in NEET PG and UG and has also approved the EWS criteria for this year so that the admissions are not dislocated for the current academic year.
A social media post of the doctors' association said: "FORDA welcomes the judgement of Hon’ble Supreme Court of India pronounced today in the matter concerning NEET PG Counselling."
The Supreme Court in its verdict on Friday (January 7) upheld the validity of OBC reservation in NEET PG and UG. In EWS, we've upheld the criteria for this year so that the admissions are not dislocated for the current academic year, Justice DY Chandrachud said adding that the petition wrt to the EWS criteria will be heard later. (Live Law)
Justice DY Chandrachud, according to Live Law, putting the reasons for upholding the NEET decision on UG, PG OBC reservation criteria said: "We accept the recommedatin of the pandey comm to apply the criteria from next year. Counselling shall be conducted by giving effect to the reservation of the OM. Validity of the criteria by Pandey comm would prospectively be subject to the result of the petition in future."

NEET UG, PG Counselling 2021: Saying that the validity of OBC reservation in NEET PG and NEET UG is upheld, Justice DY Chandrachud said: "Submissions which have been urge before this court necessitate an interim order. Formulation of the reasons would take some time."
According to Live Law, Justice DY Chandrachud said: "On Oct 21, this court sought clarification of the OM. 2 weeks were granted to UOI in this regards. On Oct 25, the UOI on its own accord deferred the counselling. Affidavit was filed on Oct 26."
Saying the petition was taken up for urgent hearing and the court have heard the counsels, Justice DY Chandrachud further added: "Later the SG had informed the court that UOI had decided to revisit the criteria and time was granted. UOI formed the comm on Nov 30 and the comm gave its report on Dec 31, 2021."
Justice DY Chandrachud, according to Live Law said: "In the 1st matter which was the judgement reserved matter, prepared an order which I'll read. There is a challenge in the batch of plea to notice issued by DGHS on July 29. Notice implements 27% reservation for OBC and 10% EWS."
"Notice takes effect from the current AY, petitioners are doc who appeared in NEET PG. Notice was issued on September 6 and results were announced on Sept 28. Arguments were heard on October 7, 2021," he added.
The Supreme Court bench assembled, according to Live Law, and Justice DY Chandrachud said: "We'll just wait for Justice Bopanna to join for a moment".

The Supreme Court will decide today whether counselling will begin on the basis of the Rs 8 lakh income criterion to determine the EWS quota.
According to Live Law, Senior Advocate P Wilson on Thursday said: "[Rs] 8 lakh so far as OBC is concerned, EWS & OBC by no stretch of imagination can be considered same. They stand on a diff footing.  It's like trying to consider unequal as equal…So far as EWS is concerned, economic criteria cannot be the sole criteria."
The Supreme Court had reserved the judgement in the EWS, OBC quota case on Thursday, January 6, meaning there will be no further arguments in the matter and the verdict will be pronounced next. The NEET decision today for 2021 will be pronounced by Supreme Court at 10:30 am.

As the Supreme Court judgement is set to be pronounced today at 10:30 am, NEET UG 2021 counselling dates will likely be announced soon.
Senior Advocate Anand Grover, according to Live Law argued that EWS reservation should be on the basis of family income and other indicators. 
"My submission is that apart from income, other indicators have not been identified. Other Economically sections criteria have been completely ignored.  In their own report, it says that they will apply the criteria prospectively meaning thereby that it is to be applied from next year but that is also not clear. They are examining the 8 lakh criteria from past records. Vast majority of people are from 0 to 2.5 lakhs and even if income tax limit is now 5 lakhs, more than 80% people are in this range.  With this criteria, if 5 lakh criteria is adopted, vast majority will fall into that. 5 lakhs is the basic criteria which should be there and there is no reason as to why 8 lakh criteria has been adopted."
The students belonging to Economically Weaker Section (EWS) were eligible for a 10 per cent reservation in admission to various medical colleges. If the EWS quota limit of Rs 8 lakh is changed, fewer students will be eligible to avail the reservation. 
Referring to income disparities in different states, Adv Datar says applying Rs 8 lakh limit uniformly across the country is arbitrary. “This quota should not be applied at all in the present year and should be deferred to next year, if at all it is to be implemented. And it should be based on the income criteria of Sinho Committee and not the 8 lakh limit criteria.”
Advocate Archana Pathak Dave for the Federation of Resident Doctors Association (FORDA), which has sought to intervene in the case, said: "NEET PG counselling has to start immediately because 3rd year residents are about to pass out in four months. We'll be left with 33% of the workforce. With 3rd wave coming we need doctors." Read More
The Supreme Court adjourned on January 5 and closed the arguments and reserved the judgement on NEET PG Counselling with respect to the EWS reservation criteria on Thursday, January 6. On Tuesday, the Supreme Court agreed to hear NEET PG Counselling dates delay case, after the Centre on Monday requested to schedule a hearing in the matter, citing "some urgency". The matter was initially listed for January 6, 2022. The Supreme Court will pronounce a judgement on NEET reservation today.

Suggesting Rs 2.5 lakh as income criterion for EWS quota, Senior Advocate Arvind Datar according to Live Law said: "I'll again say, let rules of the game not change now…Lordships may direct 2.5 L should be limit for this year for today's counselling. Rest we can see later. Let us at least preserve the integrity of Sinho Commission."

NEET UG Counselling: According to Bar & Bench, SG Tushar Mehta told the Supreme Court: "Counselling is stuck and its from graduation to post graduation. we need doctors and their concerns are genuine. as a society we cannot go into lengthy arguments now. we said we will revisit and the report has been submitted now."
The July 29 notification says that 27 per cent OBC reservation will now be extended to all seats that come under the central pool, including seats surrendered by the states towards the all India quota (AIQ). This reservation was applicable in case of central institutions in the previous years as well.
NEET PG 2021 Counselling Supreme Court: According to Live Law, SG Tushar Mehta said: "Examination has got nothing to do with reservations. So there is no basis in saying rules of the game changed. All candidates eligible for EWS as per existing criteria have got their certificates for registration. So there won't be any hardship to anyone."
